FWIW, most states which still possess distinctions between 1st and 2nd degree murder hold that planning isn't relevant or necessary, all that you need is to have decided, up to a mere moment prior to attempting to kill that death was your goal to make it 1st degree.  The whole premeditated thing exists in really very few states and is more of a TV concept.

I'm not sure what FL state law is, but to me it's certainly feasible to argue for 1st degree murder.  I don't think you get a conviction (you may not even with manslaughter due to the cuts etc), but most states would rule the shooting itself probably sufficient for 1st degree murder if it was determined he was trying to kill Martin.

It was kind of lost in the sauce but Dio's point on where the racism clearly lies, the institutionalized racism that allowed Zimmerman to walk free for over a month after he killed a black man, is what the real problem is. Racists are always going to be around but it makes it worse when the system makes it easier for racism to go unchecked.
