You're all wrong but I love the paranoia. If you're going over the speed limit that isn't probable cause...neither is 'because they feel like it'. Everyone has a recording device now, if cops search your shtein just to farg with you it won't fly. If they search youd shtein without pribable cause and fond something youll most likely get off unless its a serious offense. My buddy is a Philly cop and they've been subject to disciplinary action for illegal searches. Recording devices are your best friend in this situation. Most cop cars come equipped with dash cams now so they can't just farg with you because they're having a bad day.

It isn't paranoia at all. Dashcams or not they're doing it. Like the guy from COlorado who was pulled over in Idaho and has his shtein searched because the cop supposedly smelled marijuana

QuoteRoseen said he never smelled the odor of marijuana that Klitch claimed he detected coming from his trunk. Klitch used that odor as probable cause to search, transport and hold Roseen and his truck at the local sheriff's office.

Omg it happened once...mass hysteria! Manmade Global warming

It happens more than once...its rather frequent where police overstep their boundaries on the probable cause dashcam or not. If you don't think the police have gotten more out of line in the last, I don't know, 15-20 years then you're blind.

ice grillin you

its happened to every black guy I know minimum three or four times in their life.....its happened to me twice....and not just in a car...but I guess stop and frisk is also fake

Cameras don't the the ability to smell.

Which is why they pull the "have you been drinking?"

"No sir"

"well I saw you swerve a bit and I smell alcohol on your breath. Please step out of the car"

Dash cam shows legit conversation but that cop didnt smell anything.

ice grillin you

they can simply say you are twitchy or seem nervous

or lots of times they don't give a farg and just rock n roll...for a myriad of reasons 99% of people aren't going to press charges against the cops for an illegal search...when it happened to me when I was younger I was so happy to be let off after the search that I was like yeah lets party...when you are young and dumb you don't think about lawsuits

plus generally the people they illegally search cant afford to hire a lawyer and take off work and do all the things it takes to see a case thru....and cops know this....or the cops will run tags or a dl and see a persons record....find out about a prior and be like lets farg with this dood

this shtein is literally happening all over the place right now
i can take a phrase thats rarely heard...flip it....now its a daily word

igy gettin it done like warrick

im the board pharmacist....always one step above yous

From my experience in crim pro/working with a judge who dealt with evidence suppression often:

You don't need warrants to search cars because they're mobile.  A cop needs PC to pull a car over.  The issue is judges give a lot of deference to officers, especially in regards to the initial act of pulling a car over.  SCOTUS has already established that it's legal for the stop to be entirely pretextual.  So a cop can trail a black dude for 30 mins because he thinks he looks sketchy and wait for any justification, however remote, to pull someone over.  There still has to be an underlying traffic violation, but when a cop uncovers a semi-serious crime a judge will NEVER throw that out even with a sketchy stop.  Similarly, most police actions after a stop need something resembling PC to do a search.  The problem from a defendants perspective is most cops are adept at writing police reports to justify this PC even if it didn't necessarily exist.  Acting nervous oftentimes will be enough.   Cops are supposed to limit the search for what they're looking for specifically.  So if you think the dude has weapons and verbalized that, and find coke in an ashtray that you had to open, you can't introduce that into evidence because you had no basis for looking in the ashtray for a gun.   Likewise if you find a joint on the dude, you may have a hard time justifying a search of the trunk because it seems disconnected from just having a joint on you.

SD is right in a sense when he says a lot has to do with the seriousness of the crime.  If there's an illegal search of the trunk but they find naked pictures of children tied up, or a corpse, that's going to come in because the probative value outweighs the infringement of your rights whereas judges are more predisposed to tossing minor drug charges if they decide the search is illegal.  That being said, I part ways in the sense that I think a lot of cops slant situations either verbally or in police reports specifically to justify their illegal actions which frames the actions as legal, and then the poor black dude being tracked gets busted for his coke after the illegal search (because the cop rights the police report to make it seem like there was PC to do what he did).

Tl;dr - PC is incredibly easy to justify for any experienced cop.  The system gets gamed regularly, and judges tend (not all the time) to fall on the tough on crime side of the ledger and give most cops deference when it comes to what justified searches.  The officer may well be reprimanded privately but that doesn't help the dude who gets labeled a felon for a drug bust with trumped up PC.

PhillyPhreak54

Can I put you on retainer?

Also - I have a buddy who is a cop and one of the things he said they use a lot to justify the stop is the license plate frames. Apparently in Texas if it covers any party of the writing on the plate then it is illegal. So my Eagles frame covers up a bit of the word Texas then it is illegal and I am open to being stopped

lol @ paranoia.  try getting pulled over repeatedly because you work late and the pigs have nothing to do but harass you.  trust me, once you're on their list, you're farged.  that's not paranoia, that's real life.

ps: i work for the government.  i know how these idiots think and i know a lot of them personally.  i still wouldn't agree to have anything searched.  if they want to search my vehicle they better just go ahead and arrest me.  oh, and the whole "recording" thing?  that's farging bullshtein too.  they have dash cams and can record whatever the farg they choose, but you don't have the legal right to record them.  the opposite applies, actually.  but hey, keep trusting that the state won't ream your ass.  they like it like that.

Why is it always these Bible-thumping morons, who have nothing better to do with their miserable pathetic lives, leading the charge against equality?

Have they ever bothered to read the book they're so in love with?
