The North wasn't just the North they were the United States.  So it was the stars and stripes.  Making another flag would have been legitimizing the Confederates as a seperate country.

The United States flag.  The North was still the United States of America.

Since the South (formally the Confederate States of America or CSA) seceded and formed a new nation, they had to adopt a new flag.  The "Confederate" flag was in reality the battle flag and naval jack.  The official national flag of the CSA was the "Stars and Bars," which looked a lot like the U.S. Flag (12 stars in a circle with one large star in the middle in the blue field, three large "bars" (red-white-red) instead of the 13 "stripes").
