They CAN do whatever they want...watch them turning the marketers for Adult Swim into public enemy #1 in order to cover up their own incompetence.

I too laughed at the "they are very religious" line.  As though that makes them good people.

They had to get the search warrant to check the SUV, because the Police weren't at the scene of the road rage incident.  They needed to search the car & home to verify that there was a gun before he could be charged for anything.  They only thing that this (the gun) warrant would allow them to search for was a gun.  Surprise!  They found two unregistered guns.  If they came across something during that search, they would have to go get a new warrant to cover their new suspicions.

We don't know if the search warrant had anything to do with the needles or not.  Since it was a separate incident, they would probably have needed a separate warrant.

Needing Warrants is a good thing.  The police have to convince a judge that they have enough reason to back up a search, or that someone may be in imminent danger.

well, what about erratic driving resulting in injury to a third party+gun in car+needles in car?

NO...unless they are known drug dealers gang members murderers or some very extenuating circumstances that would validate the police to stretch a simple traffic accident/gun possesion/drug paraphernalia charge into the police turning over someones entire home

so if i get in a bar fight they cant search my home...but if i get in a bar fight and i have a bong on me and my brother has a gun on him they can then rock n roll all over my house....again BULLshtein...charge me with whats on site and what i did

otherwise next time maybe im just speeding...but maybe its really bad speeding like doubling the speed limit...which is somehow grounds to search my car...and in the car is weed residue because my boy likes the puff the occasional blunt...next thing you know they are knifeing open my couch pillows

The pigs can do whatever the farg they want, IGY.

you make good points...even so, I still have a hard time getting around injury+gun+needles.

LOL - live in Florida for a few years and you'll be amazed at what the cops can get away with.  We had a county sheriff a few years back that would instruct his deputies to pull over anyone with an out-of-state license plate and if they were carrying a certain amount of cash ($10,000 I believe?) they were under orders to seize the cash, no questions asked.

It was left to the "accused" to prove where the cash came from and why they were carrying it.  If they didn't, the pigs kept the cash.

What was even more amazing is the fact that judges from here to there sided with the cops, even though their actions were clearly examples of illegal search & seizure.

And why in the world, in this day and age, would anyone carry that much cash?  Seems like a stupid thing to do (of course, I never have more than about $20 on me, so I have no idea what it's like).

Not defending the police, just wondering why anyone would carry that much cash.

Because they want to?  What business is if of yours or anyone elses?  Maybe I'm on the way to the horse races?  Maybe I'm buying an old used car and the guy wants cash?  Maybe I don't trust the banks so I carry it?

Let's play the "probable cause for a warrant" game...

NO...unless they are known drug dealers gang members  murderers or some very extenuating circumstances
Not probable cause.  This is speculation, unless there are charges.

Quotesimple traffic accident
Not probable cause

Quotegun possesion
Assuming they did not have to do a search to determine this (plain view, third party), then this is probable cause.

Quotedrug paraphernalia
Yes, as above.

Quoteso if i get in a bar fight they cant search my home
Correct - what would they be looking for?

Quote...but if i get in a bar fight and i have a bong on me
Maybe, then there is good indication that you may abuse or traffic in drugs.  They could try to get a warrant to search for drugs and/or drug paraphernalia.

Quotemy brother has a gun on him
Yes, subject to the above and provided it is not registered.  But in this case, the gun wasn't found on him - someone reported that he threatened them with a gun.  The police wanted to find out if he even had a gun to threaten them with.  Sounds reasonable to me.

Quoteotherwise next time maybe im just speeding...but maybe its really bad speeding like doubling the speed limit
No, this would never be grounds for search.  They could ask, but you don't have to comply.

Quote...which is somehow grounds to search my car
It never could be.  They could only search your car if there is something in plain view.

Quote...and in the car is weed residue because my boy likes the puff the occasional blunt
This is not probable cause on its own, because it isn't visible.  If your car stunk, or there were roaches on the floor, yes.

My guess is that the search warrant was only for the gun, and had nothing to do with the needles.

Let's play the "probable cause for a warrant" game..

you can list what you think is probable cause till your quote button breaks....thats not the point...the point is should these things be probable cause and the answer is NO

Well, since that was too much for you to read, let me sum up:  90% of what you said was probable cause isn't.  If you have shtein on you, or have shtein spotted on you, then they can ask the judge to search for more shtein.  Period.  The rest of your commentary is bullshtein.
