Ive always wondered how they come up with that list. Most DUI's? Most alcohol-based deaths? Most STD's?

Legal Question for the board.  Anyone dealt with a DUI in Delaware? 

My buddy got popped with a DUI sunday morning at 8am.   Basically he drank all day Saturday, went to bed around 12:30, felt fine when he woke up and headed home from the beach.  Officer smelled booze on him still, did a test and he was shocked when he blew double the legal limit.  Best part about it was he had paid for a limo/taxi Saturday night to get him to Dewey and back. 

Would a judge give a crap if 8 hours after drinking he still blew double the limit?  He's a first time offender, never been arrested.  I don't know the ins and outs, and he's just shook that he could lose his license, and he has a commute to philly every day.  I just told him to go ahead an get the best lawyer he can and take any classes or whatnot they offer him.  He cant argue that he wasn't drunk, thats obvious.  Just tough to comprehend when he slept it off, and never thought that he was still feeling it.

Damn. The only people I know to get a DUI were that same night of drinking, but I feel like that story could help him out a little bit if the judge believes it.

The only close friend I know who got a DUI got it while he was in Arizona and they royally farged him. Took away is license for two years, fined him a butt ton.

Yeah, I've known people who've gotten them the night of, but never the next day.  Something can be said for getting that shower in the morning and getting the stank off.

ive known a few people who got dui's the next day...all it takes is to wake up drunk and be stopped for anything....you actually smell more like alcohol the next day cause your body is getting rid of it and often if you are driving the next morning its because you are going home and probably havent showered or anything

anyway this isnt going to be the judges first dui like this and he/she probably wont care...sometimes its even worse because it shows how much you drank the night before and the judge will deem you have a serious drinking problem....duis arent just about drinking and driving but drinking ingeneral...thats why you go to alcohol counseling for them and not drinking and driving counseling

thats said the judge probably isnt going to have much to do with the case...dooks lawyer and the prosecutor will most likely cut a deal beforehand and 99.9% chance the court/judge acepts it....most first time dui's get pleaded out to a pbj...im sure it differs by state as far as losing your liscence but as long as he didnt refuse the breathlyzer i think he should be ok...make sure he enrolls in a class asap...the prosecutor and court will like seeing him be proactive and its a fig leaf of sorts to show hes taking the issue seriously

Nah, he did the breathalyzer, and coudlnt believe that it was .14.  He acutally asked if they would draw blood, because he just couldn't fathom how that was right.  Now he's bugging because if its more than .15 he's considered out of the first time offender program.  He's already setup the classes and meets with his lawyer tomorrow.  He was completely complicit, the officer told him he knew he wasnt some POS, but once he set the wheels in motion it couldn't stop.

also if i got my liscence suspended id still drive to work...just dont be a douche and dont drive anywhere else...but if he does get it suspended in a lot of states theres the option of having an alcohol restricted liscence thats allows you to drive only to and from work....you can also i think get an interlock on your car in lieu of losing a liscence

btw liscence is easily the hardest word in the english language to spell and i still dont know how to do it...if i ever get it right its only because of a wild and lucky guess

if he was shcoked because he didnt think he drank that much the night before thats one thing....but if hes shocked cause it was the next day then he shouldnt be

.14 is not that high for the morning after a binge fest

it is a fig leaf because no way dook is taking those bogus classes for real nor does he think he needs them and he will absolutely drink and drive again someday

i believe an olive branch is a legitimate peace offering...whereas a fig leaf is an offering disguised in a ruse
