Anyone ever go to small claims court specifically in relation to tenant/landlord/security deposit disputes? My lease says my old landlord had 30 days to provide us with an itemized list of deductions she's taking form our security deposit or she may have to pay us up to double the cost of the security deposit. 30 days has passed with no response. I text her today to she if she sent it and she said no she hadn't and that she isn't giving us anything back because of the cost of repairs. I told her the terms of the lease and she back tracked and said she spoke to her Aunt who sent it two weeks ago [bullshtein]. So I'm suing her for $2500 which is double the security deposit plus the escrow amount our security deposit was supposed to go into after year two which she never gave to us.

i threatened my last landlord with small claims court...she fought it most of the way blah blah until she realized she would have to travel from florida to dc for court, then ended up giving us all the money back. including interest. so i can't technically help but hopefully the inconvenience of dealing with it will make her just give in.

The landlady in Kingpin is what she'll look like in 10 years. She was a zesty landlord which is why we took before and after pictures and I knew she was too stupid to realize she'd have to pay us double the security deposit. I've spoken with people in my office who own and rent property in Philly and they said the Judge usually sides with the tenant unless there's something totally unreasonable like holes in the wall or reckless damage.

Just called a company who I used to do some business with years ago, asking for my old contact..

"Umm, yea, he's been dead now for 2 years - who the hell is this?"

Aside from immediately hanging up, I don't know how to respond to that.

Awkward for sure - but short of them sending an email blast that dude kicked it, you cant be expected to know.

One of the guys I work with openly rooted for a purchasing agent to die so he could sell the company. The farged up thing is the dude ended up dying. Maybe I work with the grim reaper?

Looks like you've documented everything and have the terms of the lease in writing. Unless they were written in some other language, the judge should look at this and point and laugh at the landlord while awarding you the damages. Make sure you continue to CYA and note down the conversations you've had with her. Email is the best that way you can have it in writing...otherwise, make good notes with times and dates and names, etc., and take everything you have to court.

This should be a slam dunk case for you...the only bullshtein is going through the hassle and waiting for the landlady to pay you or give you your money back.

PA state law mandates a landlord has 30 days to provide a list of damages, otherwise they lose rights to the security deposit. The tenant can sue for either the full amount of the security deposit which the landlord cannot counter with any damages. Or the tenant can sue for double the amount of the security deposit but the landlord can claim damages.
She said twice she never sent anything then backtracked and said her Aunt sent it. She's full of shtein and shady and I wouldn't put it past her having her Aunt show up in court to say she sent something. We obviously never received shtein. So I guess it's up to a judge to make that ruling. They try to handle these situations in arbitration first. My thing is if she would have returned half the deposit and said she spent the other half on whatever I wouldn't have a problem, but she's claiming we caused over $1100 worth of damage which is total bullshtein.
