Had the guy simply tried to defend himself against the DUI charge, I wouldn't have any problem with him.  His attempt to manipulate the court however reveals a lack of character that I don't think I could ignore if anyone asked me what I thought of the guy.

I'd be reserved in my criticism.  What I'd probably do is give him faint praise and let the prospective employer read through the lines:

"He was punctual and did not cause any problems in the work place, when he wasn't absent due to personal legal problems."

People amaze me. If I was that guy Sarge, I'd make sure I never crossed paths with anyone who knew my story, and I especially wouldn't go asking for assistance from someone who did.

I agree w Dio - had he come clean with the DUI and handled it the right way, that's one thing. Coming into court though in uniform, when he had no business doing so just to be at the mercy of the courts, in my eyes, is unforgivable and shows what he true character is.

Easy answer, if you ask me - Tell the entire truth.

I wouldn't say he "came up" with the idea at all.  Members of the military are quick to wear the uniform in public whenever they think there's a chance they can use it to their advantage and have been for years.  I've had to go to traffic court twice for speeding tickets and wore my uniform both times hoping for, and receiving leniency.  I also do it every year when we celebrate the Marine Corps birthday.  I have to wear my dress uniform to the ceremony and I know if I keep it on afterwards and go to a bar, I'm drinking for free for the rest of the night. 

But yeah, his character sucks.  He got the DUI about a week or so after he checked in to my command and didn't tell anyone, thinking that he could fight it on his own with no one finding out.....which is shady in the first place.  Then there's the perjury thing on top of that.  Not to mention that while his work habits were fine while he was working for me, there were other "minor" character issues as well.  I think I'm just going to ignore it, but still get drunk and then email him letting him know he's a moron for asking me for character references.  My guess is that he emailed it to everyone in his address book and didn't bother looking at who he was actually emailing.  It's been about 4 years so the guy very well could have made the appropriate changes in his life, in which case my commentary could prevent him from getting the job.

Yes, but he's far from the first to do it after serving as well.  Hell, I remember a few years back reading a story about a guy (Marine I think) who served 4 years, did a deployment to Iraq, came back and got out.  Dude managed to get hold of an actual Medal of Honor and began passing himself off as a MoH recipient.  There are A LOT of perks that come with that.  I forget when or how, but he ended up getting found out and was in deep doo-doo.  Like "spend a few years in prison" doo-doo.  I don't recall what actually ended up happening to the guy but he was running a pretty nice scam for a while there.

I read a story recently about a pastor that was passing himself off as a member of the Navy SEALs.

I knew a girl in San Diego who was supposed to marry Mike Grogan (guy claimed he was ex-Pats QB Steve Grogan's brother) who said he was also a former Navy Seal. I met him a few times and he seemed like a nice enough guy. My g/f and I were invited to the wedding but I was deployed (g/f was to be a bridesmaid). Night of the wedding rehearsal US Marshalls raided the restaurant he was at (was also part owner) and arrested him for wire fraud and a bunch of other charges.
