Why is that?  Scopes was tried and convicted.  On appeal to the Tennessee Supreme Court, the conviction was overturned on a technicality, but not the law itself.  In fact, two more states instituted laws based on the Butler Law (the one in question in the Scopes Trial) after the trial's conclusion.

If anything, this is an example that proves that the crass manipulation of the legal and political system by the media did not start in modern times.  Scopes wasn't even sure if he had taught evolution (in fact, he was only a substitute teacher), but volunteered to be the defendant, and even helped to engineer his arrest.  The whole trial became centered on the personal confrontation between special prosecutor William Jennings Bryan (three-time Democratic nominee for President and Secretary of State under Woodrow Wilson) and Clarence Darrow, the main defense lawyer.

The Scopes Trial to me was mainly about a couple of blowhards (on both sides of the trial) trying to preen for a media that was more eager to sell papers then it was for the actual debate to be heard.  Sensationalism ruled the day then, too.

On a semi-interesting side-note, the trial must have been too much for William Jennings Bryan.  He died just five days after the trial's conclusion, never leaving the town the in which the trial was conducted (Dayton, Tennessee).

Exactly.  The main reason for starting the whole thing in the first place was to create controversy and get Dayton, TN nation/worldwide recognition.  But that still shouldn't downplay the significance of the case.  Nor should it downplay the rediculousness displayed by religious zealots.
