Sarge, here's a story I want your opinion on.

My son an E5 (select) in the USAF was until recently stationed in Europe.

He and a few of his buddies got a little loaded one night and tag teamed a civilian female employee. One of them videoed it on his camera phone. A few nights later, the idiot who videoed it was showing the video off around the E-club. The chicks boyfriend saw it and smacked her around. Anyway, she presses rape charges and rotates home. They go under investigation. The video showed it was fully consensual and those charges were dropped. However they had to take art 15 on charges of lewd behavior and transitting in pornography. He ended up losing both his E5 (would have been sewed on in January and his E4. He should be able to get E4 back in February and retest E5 in May. Is that f'ed up or what?

Of course it's farged up, but from that brief description, it sounds like it was handled properly and the appropriate punishment was handed out.....at least in accordance with military law.  Taking his selection and then busting him down a rank on top of it is a bit excessive and not very common (at least from what I've seen) but it's still within the realm of what would be considered appropriate.

Just like in the civilian world, there are plenty of rules in the military that are dumb and punishments that don't always make sense.  But those are the rules.  Only difference is that getting them changed in the military is a hell of a lot harder than changing them in the civilian world.

Here is the dumbest thing I've seen in 16 years of service:

Young kid (E2 or E3) got in trouble with a couple credit cards, missed some payments, bounced some checks, etc etc.  Stupid kid, it happens.  Bouncing checks is punishable by Non Judicial Punishment (NJP).  So this kid bounced a check at the PX on base, the manager called the commanding officer and next thing you know, the kid gets NJP.  He tells the CO of his financial problems and the debt that he has accumulated (about $5000, which was about 5 months woth of his salary). 

So what does the CO do for punishment?  Reduction in rank to E1 (which now means he's taking a pay reduction) and then forfeiture of 1/2 months pay for 2 months....so basically, docked him 1 month pay.  Now tell me how any of that would help this kid get out of debt.

Exhibit A and Exhibit B why I got out of the Navy. Getting in trouble for petty shtein and seeing how they go all out to crack down on E-6 and below, but when an officer beats up a hooker and gets arrested he gets a slap on the wrist (true story) or when my former Chief gets in a fight because he's drunk and is arrested nothing happens.

If you watch the Wire, when Herc sweats losing that camera because the dickhead LT. is the type that takes stripes because of petty shtein, that's everyday life in the military.

That is some dumb sthein your CO did, but from my short military career that sounds fairly common.  And Weirdo it does sound like your kid got what he deserved.....to a point.  I don't agree with him going to E-3.  NCOs are supposed to set a good example.  Unfortunately a lot don't
