Agreed. The problem is with enforcing it. Maybe some super steep fines for those who are proved to be using cell phones in an accident would help. But again, the tought part would be proving it.

There are however a lot of fargers driving while distracted.  It's one thing to speak to a passenger, who's vested interest and eyeballs offset the driver's distraction, and it's another entirely to yap away on the phone with someone who just like you can't see that bicyclist, pedestrian, semi, etc.

Would it really be that hard?  Subpeona the phone records--or call the White House, they've got 'em--and you can see if the phone was in use or not.  Plus, every phone has GPS--that's how 911 works no matter where you are.

I don't see how it would be harder to prosecute than the current laws about holding the phone.

i concur.

i am guilty of using a cell phone while driving once in a while. i try not to do it for more than a minute or two. but when it's a long conversation i avoid distracted driving by just flipping on the cruise control and make sure one hand is on the phone, and the other hand is blocking out noise in my other ear.

I've gotten head while driving, and it's very distracting.  HOWEVER, not only should it be legal, but encouraged as well.
