Washington— If HBO gets into a contract dispute with EchoStar, the satellite company would have compulsory access to HBO's other distribution contracts under proposed rules supported by Federal Communications Commission chairman Kevin Martin, according to communications lawyers familiar with the plan.



Martin's proposal would create an expansive discovery right under the agency's program-access rules, which provide cable's pay TV rivals with the ability to license on reasonable terms any satellite-delivered network with at least 5% cable operator ownership.



The requirement that cable operators must sell certain networks, also called the exclusivity ban, is to sunset on Oct. 5 if not extended by the FCC. Created by 1992 Cable Act, the program-access mandates were extended for the first time in July 2002, an effort Martin (then just a commissioner) barely, if not grudgingly, supported. The 2002 vote was 3-1. Had Martin dissented, there would not have been a majority for a five-year extension.



Now Martin is proposing a second five-year extension, giving AT&T, Verizon, DirecTV and EchoStar ongoing distribution rights, for example, to Time Warner's CNN, Comcast's Golf Channel, and Cablevision's Madison Square Garden Network.



In the event of a dispute, Martin is proposing that either the FCC or the complaining party may compel access to all programming contracts between the cable-affiliated network and other multichannel video programming distributors (MVPD). Disputes may also be resolved by baseball-style arbitration, with the FCC's Media Bureau acting as umpire, lawyers said.



The FCC's next public meeting is Sept. 11 but an agenda has not been released. The FCC has five members, three Republicans and two Democrats. Only Republican Martin and Democrat Michael Copps were around in 2002 for the first extension vote.



In other proposals, Martin is seeking support for a notice of proposed rulemaking to examine whether the exclusivity ban should include terrestrially delivered, cable-affiliated networks.



EchoStar, in particular, has repeatedly called for closure of the so-called terrestrially loophole, usually in the context of its inability to distribute Comcast SportsNet Philadelphia.



The notice is expected to explore an American Cable Association-supported matter, one that involves the business relationship between programming giants like Disney and Viacom and their pay-TV distributors. ACA has complained that programmers lean on their distributors to license a suite of channels regardless of consumer demand for a specific channel.



"We call it tying and bundling," ACA president Matt Polka said Friday, adding that his organization asked the FCC to look into the issue in a 2002 petition for inquiry.



Viacom and Disney have rejected ACA's claims in filings at the FCC.




Pretty big to bring this back up.  I thought that battle was lost, but it looks better now.

Basically, They are going to review the loophole that Comcast has exploited forever.  They reviewed it in march but the FCC's Martin did not reverse the previous decision that Comcast can do what it wants only with Comcast Philly Sportsnet.  The Satellite companys are still forcing the issue, and somehow there might be a chance that those outside philly could get CSN Philly in a sports package.

It'd be nice to be able to finally get CSN Philly through my dish.  It really pisses me off that I can get CSN B-more and Chicago and I think one other channel, but I can't get Philly.  Dicks.

even if comcast gives up CSN-philly to satellite, i'm sure they will black it out in the philly area so it won't do me any good anyway

pretty people who choose to live in maryland don't deserve to see flyers post game live with al morganti

Is pretty a new filter?  Hey, i already dish out 150 bucks to watch NHL Center Ice just to watch Flyers games, if i could save that per year, that means NFL Ticket for me. 

Sun, Verizon Fios offers CSN Philly.  Comcast to make concessions may offer to blackout Philly, but offer it to the rest of the country, but i doubt the FCC would go for that.  If they open that channel for philly and the country, it would be time to dump any stock you have in Comcast immediately.

Hey, i already dish out 150 bucks to watch NHL Center Ice just to watch Flyers games

but isnt the sports tier that holds channels like the csn's around the country like 15 extra per month

They couldnt do that.

In fact, verizion fios in philly carries CSN without it being blacked out.

Its only 10 bucks, so i would spend 10 extra a month for CSN Philly basically, plus get all the other channels.  So $120.00 is a bargain in my mind

I would think that the only way that ever happens is if Comcast says the rest of the country could get it, but philly would remain under comcast and verizon.  Then the satellite companies would have to agree, then the FCC. 

The loophole that CSN Philly uses is:  They used to be on the Prism Microwave network, the old loophole said that Comcast had exclusive rights to that special type of broadcast unless the other providers had the same technology.  Comcast went to Fiber optic a few years back, and since Fios is the same, they had no choice but to share.

my point is the nhl package is 150 so you only be saving 30 bucks....in terms of spending another 300 on the nfl package that isnt much

Sarge, you realize you could have just purchased a home depot 5 gallon bucket, put a metal or even pvc pole in it, then attach the satellite.  Throw some quickcrete in there, and you would have saved more money than switching to Geico

Yes.  The only problem was that I was not made aware of the problem until the installer actually showed up at my place other wise I would have been ready.  I just wanted to get my service set up.  What I may do sometime in the near future is get the bucket and fill it with concrete and then call Directv and tell them I want to upgrade to HD again.

Make sure they do not charge you, i had a similar situation with my installer and really had to bust heads to get them to pay it.

or try what I'm considering,  install Slingbox at someone's house in So.Jersey/Philly that has CSN. 

I have no idea if Slingbox really works as promoted.  It's probably too good to be true, otherwise people would be setting up units all over...semi-legal stealing of cable.

I think what you'd find is that, except for the local station, the games (NHL, MLB) would be blacked out if you don't have the sports package as well.

No word yet on the meeting that was to take place Tuesday, they have pushed it back every day.
