Update...

Florida State granted exemption from the NCAA for use of the Seminoles name.

http://sports.espn.go.com/ncaa/news/story?id=2141197

 :-D

Basically, the NCAA knuckled under after Florida State threatened to sue their ever-living balls off over the issue.

I wonder how many other special exemptions will be granted now that the precedent has been set?

 :evil
To be fair (as mentioned in the article), FSU does work with the Seminole nation to ensure that they do not misrepresent their namesakes.

How do football teams misrepresent their namesakes?  Get drunk and go gambling?

Most sports mascots are a caricature of what they represent - they oversimplify or make fun of an object.  Take the Cleveland Indians big goofy smily indian, or the obviously racist nickname "taterskins" - they do not represent native americans favorably, and may even be considered derogatory.  Even the term "Indian" can be considered racist, the name coming from europeans finding this continent while searching for India.

The Florida State University has worked with the Seminole nation to ensure that the school's mascot and its representation is consistent with Seminole tradition,  that the costumes used are authentic, and that their ceremonies and traditions are presented fairly and in a way that portrays the nation in a good light.  They ensure that the team's use of the name and iconography is done in a way that honors the tribe, rather than being stereotypical.

One of my soccer teams as a youngster was the "Sioux".
