That's because sexual orientation is not on the list of hate crimes in Pennsylvania.

The state did pass a hate crime law in 2002 that covered the LGBT community but the Pennsylvania Supreme Court struck it down on a technicality.

Legislation was re-introduced in 2009 but failed to make it out of committee.

Not surprised by this. At the federal level, homosexuals are not considered a "protected class."  When the military allowed soldiers to openly identify as gay, they were still not given all the same benefits as straight soldiers. They are also not protected under EEO policies. So while it's unacceptable for a soldier to use a racial slur towards minorities or to use a sexual slur towards women, there are literally no repercussions for openly discriminating against a gay soldier.

So in order for a hate crime to exist,  homosexuals have to be in the same protected class as minorities or handicapped, and I don't think very many states have done that.
